EXPLANATORY NOTE | ||
(This note is not part of the Instrument and does not purport to be a legal interpretation.)
This Order commences section 6 of the Civil Registration (Amendment) Act 2014 to provide that a mother of a child must give to the registrar the required particulars of the father of her child, unless she has a compelling reason for not doing so.
The Order also provides a new mechanism that allows a married mother to apply to a registrar to rebut her husband’s paternity of her child. The mother can provide a statutory declaration to that effect, accompanied with some evidence that indicates she has been living apart from her husband for 10 months prior to the birth of her child. |
