I, DARA CALLEARY, Minister for Social Protection, in exercise of the powers conferred on me by section 1 (3) of the Civil Registration (Amendment) Act 2014 (No. 34 of 2014), hereby order as follows:

1. This Order may be cited as the Civil Registration (Amendment) Act 2014 (Section 6) (Commencement) Order 2025.

2. The 10th day of December 2025 is appointed as the day on which section 6 of the Civil Registration (Amendment) Act 2014 (No. 34 of 2014) shall come into operation.

EXPLANATORY NOTE

This Order commences section 6 of the Civil Registration (Amendment) Act 2014 to provide that a mother of a child must give to the registrar the required particulars of the father of her child, unless she has a compelling reason for not doing so.

The Order also provides a new mechanism that allows a married mother to apply to a registrar to rebut her husband’s paternity of her child. The mother can provide a statutory declaration to that effect, accompanied with some evidence that indicates she has been living apart from her husband for 10 months prior to the birth of her child.
