S.I. No. 591/2025 - European Communities (Marketing of Honey) (Amendment) Regulations 2025

I, MARTIN HEYDON, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Directive 2024/1438 of the European Parliament and of the Council of 14 May 20241 , hereby make the following regulations: | ||
1. These Regulations may be cited as the European Communities (Marketing of Honey) (Amendment) Regulations 2025. | ||
2. The European Communities (Marketing of Honey) Regulations 2003 ( S.I. No. 367 of 2003 ) are amended- | ||
(a) in Regulation 2(1) by substituting for the definition of “Council Directive” (as amended by the European Communities (Marketing of Honey) (Amendment) Regulations 2015 ( S.I. No. 261 of 2015 )) the following- | ||
“‘Council Directive’ means Council Directive 2001/110/EC of 20 December 20012 as amended by Directive 2014/63/EU of the European Parliament and of the Council of 15 May 20143 and Directive 2024/1438/EU of the European Parliament and of the Council of 14 May 2024;”, | ||
(b) in Regulation 3, by substituting for paragraph (2) the following– | ||
“(2) A person shall not place on the market a product to which these Regulations apply unless that product meets the requirements set out in Annex II to the Council Directive.”, and | ||
(c) in Regulation 4, by inserting after paragraph (3) (inserted by the European Communities (Marketing of Honey) (Amendment) Regulations 2015) the following- | ||
“(4) A person may place honey produced or labelled before 14 June 2026 on the market in accordance with Article 6 of Directive 2024/1438/EU of the European Parliament and of the Council of 14 May 2024 until stocks are exhausted.”. | ||
3. These Regulations shall be deemed to be food legislation for the purposes of the Food Safety Authority of Ireland Act 1998 (No. 29 of 1998). | ||
