S.I. No. 383/2025 - Electoral Act 1997 (Variation of Monetary Amount) Order 2025

I, JAMES BROWNE, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by section 3(1) (as amended by section 44 (b) of the Seanad Electoral (University Members) (Amendment) Act 2024 (No. 40 of 2024)) of the Electoral Act 1997 (No. 25 of 1997) (as adapted by the Housing, Planning and Local Government (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 408 of 2020 )), hereby order as follows:

1. This Order may be cited as the Electoral Act 1997 (Variation of Monetary Amount) Order 2025.

2. The monetary amount specified in paragraph (b) (inserted by section 5 (1) of the Electoral (Amendment) Act 2011 (No. 14 of 2011)) of subsection (1) of section 21A of the Electoral Act 1997 (No. 25 of 1997) is varied to €250,000, in lieu of €200,000.

EXPLANATORY NOTE

This Order amends section 21A(1)(b) of the Electoral Act 1997 (No. 25 of 1997) to provide for the reimbursement to a candidate at a presidential election of his/her actual expenses incurred or €250,000 whichever is the less, subject to fulfilling the criteria prescribed in section 21A(1)(a) of the aforesaid Act.
