S.I. No. 374/2025 - Merchant Shipping (Health and Safety General Duties and Reporting of Marine Incidents) (Amendment) Regulations 2025

I, SEÁN CANNEY, Minister of State at the Department of Transport, in exercise of the powers conferred on me by section 87 of the Merchant Shipping Act 2010 (No. 14 of 2010) (as adapted by the Transport, Tourism and Sport (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 351 of 2020 )) and the Transport (Delegation of Ministerial Functions) Order 2025 ( S.I. No. 144 of 2025 ), hereby make the following regulations:

1. These Regulations may be cited as the Merchant Shipping (Health and Safety General Duties and Reporting of Marine Incidents) (Amendment) Regulations 2025.

2. Regulation 12(2) of the Merchant Shipping (Health and Safety General Duties and Reporting of Marine Incidents) Regulations 2023 ( S.I. No. 441 of 2023 ) is amended by substituting for subparagraph (a) the following:

“(a) take all reasonable precautions to prevent marine incidents and occupational hazards, injuries and diseases on board the ship, including through the provision of all necessary appropriately sized personal protective equipment and measures to reduce and prevent the risk of exposure to harmful levels of ambient factors and chemicals as well as the risk of injury or disease that may arise from the use of equipment and machinery on board the ship,”.

These Regulations provide for the 2022 amendments to the Maritime Labour Convention 2006 in relation to health and safety and accident prevention. In particular, they set out the requirement for the shipowner to provide seafarers with the necessary appropriately sized personal protection equipment.
